6. No advice.
The Intelligent Recommendations website is an information platform containing information on the recommendations shared by users.
Neither the Intelligent Recommendations offers nor the recommendation results depicted in the tables constitute guidance on investment, products or services. . User recommendations are private expressions of opinion and are users’ personal assessments of the offer to select products and services made available in the tables. User recommendations are entered by users of the website by saving the selection and are collected for statistical purposes by Intelligent Recommendations to be presented on the website, evaluated automatically but not processed in a user-specific manner in tables.
The ranking in the recommendation tables and model stock portfolios is randomized and results solely from the individually collected recommendations of the users and the list of recommendations according to the results most frequently named. The information contained under this heading cannot replace individualized guidance by a specialist.
The user determines his own risk appetite at his sole discretion, enters his recommendations independently and can view the results of all recommendations shared with the website.
Intelligent Recommendations is unable to recognize any possible recommendation profile through this and each user’s individual needs for information and/or advice are not known to Intelligent Recommendations, thus Intelligent Recommendations is not in a position to assess users’ individual interests or desired recommendations. In so far as Intelligent Recommendations classifies the products depicted, this only represents an estimation on the part of Intelligent Recommendations which has been made according to specific criteria. Should the classification in combination with the depiction of user recommendations shared result in a positive estimation of individual products or services, this nevertheless does not constitute a recommendation to use the service or acquire the product. Intelligent Recommendations in fact recommends the user seek out the advisory services of an expert in the relevant field prior to making an individual decision on use or acquisition.

7.1. The user is obliged to provide Intelligent Recommendations with a correct and complete e-mail address.

7.2.Furthermore, the user is obliged to log in from only one e-mail address and accordingly to only submit recommendations in the investment areas and subordinate categories as one single user (one e-mail address).

8.1The webmaster is obliged to protect the investment recommendations which have been entered to the best of his knowledge against manipulation so that collective intelligence is vouchsafed on the website and that no incorrect recommendations are made.

9.1. Our provider saves the IP addresses of the visitors to our homepage. The visitor’s identity remains unknown to us. As a rule, IR’s online offers may be utilized by the user without revealing his identity. The use of the service to share recommendations or to view recommendations is available upon registering using any user name or any purely fictional user name along with a password selected by the user. Additionally, the user’s e-mail address is collected during the registration process. Analysis and evaluation by collective intelligence criteria cannot be made available without this information. During the registration process, profession and age (year of birth) are also collected in order to review the collective intelligence of the recommendations. Your data shall be processed in accordance with the regulations set out in the German Telemedia Act [Telemediengesetz] and the German Data Protection Act [Bundesdatenschutzgesetz]. We shall not pass on personal data to third parties. Personal data include all information which can be used to directly or indirectly identify an individual. Statistical evaluations (such as those of experiences entered compared with investment recommendations to date, the user’s own risk appetite and the recommendations shared) shall be carried out solely in anonymized form. Furthermore, we shall not collect, use or process personal data without your express consent. You may revoke your consent at any time. Upon request we shall provide you free of charge information concerning your personal data we have stored. Under "Start/Account/Show profile" users who are logged in may also view and update data entered at registration. At any time you may request your personal data we have on file be corrected, deleted and/or blocked. Your data shall not be transmitted to third countries outside the European Union.

Our website uses Google Analytics, a web analysis service of Google Inc. ("Google"). Google Analytics uses so-called "cookies", i.e. text files which are saved on your computer and thus allow an analysis of your usage of our website. The information generated by cookies on the website usage is transmitted to and stored on a Google server. Google uses this information to evaluate website usage in order to compile reports on website activities for the website operators and to provide further services linked to website and Internet usage. Where necessary, Google will also transmit this information to third parties in so far as this is legally proscribed or in so far as third parties are to process these data on Google’s behalf. Under no circumstances will Google bring your IP address in connection with other Google data. You can prevent the installation of cookies using your browser software’s settings; we do, however, advise you that under these circumstances you may not be able to use the full range of all of the website’s functions. By using the website you agree to the processing of the data collected about you by Google in the aforegoing mentioned manner and for the aforegoing stated purpose.

10.1 Should individual provisions of these general terms and conditions be or become void, the remaining provisions shall remain unaffected. Instead, in place of any invalid provision a replacement provision to correspond with or at least approach the purpose of the contract by achieving the same commercial result originally intended by the contractual parties, had they been aware of the invalidity of the provision. The same shall apply in the case of any incompleteness in the contract.
10.2 The law of the Federal Republic of Germany shall apply.

10.3For businesses in the sense of section 14 of the German Civil Code [Bürgerliches Gesetzbuch, hereinafter referred to as BGB] Hamburg is the agreed court of jurisdiction.

11.. No caution without previous contact
Should any content or the design of these pages infringe third-party rights or violate legal regulations, we kindly request appropriate notification without charge. We guarantee that any passages containing genuine cause for objection will be removed immediately without any need for taking legal action on your part. We will, however, reject in full any costs incurred by you without prior contact, and if necessary report violations of the aforementioned provisions.

Registrierte und nicht-registrierte Nutzer können bei Intelligent Recommendations entgeltlich zusätzliche Servicedienstleistungen buchen. Einzelheiten über Inhalt und Preise der kostenpflichtigen Servicedienstleistungen ergeben sich aus den in den Service-Bereichen der Webseite befindlichen Angeboten und im Produktbereich der Website.
Diese Geschäftsbedingungen finden auf kostenpflichtige Leistungen von Intelligent Recommendations Anwendung. Ergänzend gelten die Allgemeinen Geschäftsbedingungen von Intelligent Recommendations.

2. Laufzeit Der Vertrag wird entsprechend des Zeitraums oder des Bestellumfangs der Leistungsoption geschlossen:

Leistungsoption 1: Premium-Mitgliedschaft
Leistung: Wöchentliche Aktualisierung unseres Systems mit Einsicht auf das wöchentliche Musterdepot + Ansicht der letzten 12 wöchentlichen Musterdepots.
Leistungszeitraum: 3o Tage Premium-Mitgliedschaft = 21,01 Euro zzgl. Mehrwertsteuer. Gesamtpreis inklusive MWSt (3,99 Euro) = 25 Euro.

Sonderaktion für kurze Zeit: 3o Tage Premium-Mitgliedschaft = 8,40 Euro zzgl. Mehrwertsteuer. Gesamtpreis inklusive MWSt (1,59 Euro) = 9,99 Euro.

Leistungsoption 2: Profi-Trader
Leistung: Tägliche Aktualisierung unseres Systems mit Einsicht auf das tägliche Musterdepot + Ansicht der letzten 12 täglichen Musterdepots.
Leistungszeitraum: 3o Tage Profi-Trader = 37,82 Euro zzgl. Mehrwertsteuer.
Gesamtpreis inklusive MWSt (7,18 Euro) = 45 Euro.

Sonderaktion für kurze Zeit: 3o Tage Profitrader-Mitgliedschaft = 21,01 Euro zzgl. Mehrwertsteuer. Gesamtpreis inklusive MWSt (3,99 Euro) = 25 Euro.

Leistungsoption 3: IR-Börsenbrief
Leistung: Wöchentlicher Börsenbrief mit Analyse und Zusammenfassung des Intelligent Recommendations-Systems. Der IR-Börsenbrief berichtet über die Informationen und Prognosen zur Asset Allocation und Bericht über Neuaufnahmen von Aktien, Fonds und Rohstoffen. .
Leistungszeitraum: 28 Tage/4 Ausgaben = 31,93 Euro zzgl. Mehrwertsteuer.
Gesamtpreis inklusive MWSt (6,07 Euro) = 38 Euro.

Leistungsoption 4: Seminar
Leistung: Angebot: Seminar. Inhalt: Siehe Details und aktuelle Seminarreihe unter Premium/Produkte.
Preis zur Seminarteilnahme = 126,05 Euro zzgl. Mehrwertsteuer.
Gesamtpreis inklusive MWSt (23,95 Euro) = 150 Euro.
Zzgl. 9,75 Euro Buchungsgebühr unseres Partneruntnehmens: Eventbrite.

Leistungsoption 5: Robo Trading/Speed Trades/Signaldienst

Inhalt: Börsentage (2 Wochen Montag-Freitag) 50-100 Trades pro Tag. Open/Close Position. per Email versendet.

Leistungspaket 4: Quarter
Inhalt: Börsentage (2 Wochen Montag-Freitag) 13-25 Trades pro Tag. Open/Close Position. per Email versendet.
Gesamtpreis inklusive MWSt = 125 Euro.

3. Zahlungsbedingungen Dem Nutzer stehen im Falle der Leistungsoption 1-3 als Zahlungsmöglichkeiten die Zahlung über PayPal (Abo) und im Falle der Leistungsoption 4 die Direktüberweisung auf unser Konto zur Verfügung. Die Zahlung über PayPal kann einfach und bequem per Kreditkarte durchgeführt werden, auch wenn Sie keinen PayPal-Account besitzen. Für die Abwicklung der Zahlung und die Inhaberschaft an den Zahlungsforderungen gelten die allgemeinen Geschäftsbedingungen des von der Betreiberin angebotenen und vom Nutzer gewählten Anbieters. Leistungsoption 5 funktioniert per Überweisung.

4. Kündigung Der Vertrag wird für die Dauer der Laufzeit der Leistungsoption geschlossen und verlängert sich durch eine Abo-Funktion im Falle der Leistungsoption 1-3 automatisch. Ihr Abo bleibt solange gültig bis Sie es kündigen. Die Kündigung des Abos muss vor der monatlichen Verlängerung des Abos erfolgen, um zu verhindern, dass Sie mit der nächsten Wochen- oder Monatsgebühr belastet werden.

Abos werden im Voraus bezahlt und die Kontogebühren können nicht rückerstattet werden. RÜCKERSTATTUNGEN ODER GUTSCHRIFTEN FÜR TEILWEISE GENUTZTE MONATE SIND NICHT MÖGLICH. Ihr Abo ist jederzeit kündbar. Das Abo kann einfach und direkt bei PayPal gekündigt werden. Die Kündigung tritt sofort in Kraft. Beachten Sie bitte, dass bei einer Kündigung des Abos die zuletzt (oder früher) abgebuchten Monatsgebühren nicht rückerstattet werden. Durch die Anmeldung für ein Abo durch Buchung der Leistungsoption 1-3 und die Angabe von Zahlungsinformationen erklären Sie sich mit diesen Zahlungsbedingungen einverstanden.

Widerrufsrecht

Als Verbraucher können Sie Ihre Vertragserklärung innerhalb von zwei Wochen ohne Angabe von Gründen in Textform (z.B. Brief, E-Mail) widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Vertragsschluss und auch nicht vor Erfüllung unserer Informationspflichten gem. § 312c Abs. 2 BGB in Verbindung mit § 1 Abs. 1, 2 und 4 BGB - InfoV. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs. Der Widerruf ist zu richten an:

Widerrufsfolgen

Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und gegebenenfalls gezogene Nutzungen herauszugeben. Können Sie uns die empfangene Leistung ganz oder teilweise nicht zurückgewähren, müssen Sie uns insoweit gegebenenfalls Wertersatz leisten. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit der Absendung Ihrer Widerrufserklärung, für uns mit deren Empfang.

Besondere Hinweise

Bei einer Dienstleistung erlischt Ihr Widerrufsrecht vorzeitig, wenn Ihr Vertragspartner mit der Ausführung der Dienstleistung mit Ihrer ausdrücklichen Zustimmung vor Ende der Widerrufsfrist begonnen hat oder Sie diese selbst veranlasst haben.
